Advertising terms and conditions

The University of Technology, Sydney ('University') is committed to supporting EEO principles and practises which do not discriminate against any individual or group. The following terms and conditions cover the advertising of all employment opportunities by the UTS Careers Service on behalf of individuals and organisations.

1. All job advertisements submitted must comply with Commonwealth and NSW law.

a. Prospective employers shall not advertise in a way which discriminates against a person or section of the community on account of their sex (including pregnancy), sexual preference, transgender status, race, colour, ethnic or ethno-religious background, descent or national identity, marital status, family responsibilities, disability, age, political conviction or religious belief.

b. Prospective employers shall also ensure that the advertisement complies with all relevant legislation including, but not limited to:

  • Trade Practices Act 1974 (Cth),
  • Fair Trading Act 1987 (NSW); and
  • Privacy Act 1988 (Cth).

c. Prospective employers must also intend to provide a safe and lawful working environment for the University students or graduates that complies with all relevant health and safety and employment legislation.

2. All advertisers must provide the following information

a. The name of the individual or organisation advertising the job vacancy.
b. The name of a contact person.
c. The address and phone number of the organisation, individual or contact person.
d. The organisation’s website, if available, or alternatively brief information about the organisation and industry.
e. The organisation's ABN, where one exists.
f. An adequate and accurate description of the nature of the work being offered. Advertisements shall not be misleading, misrepresentative or deceptive or be likely to mislead, misrepresent or deceive.
g. All advertisers indemnify the University, its officers, staff and agents from and against any loss, damage or expense (including reasonable legal costs) arising from any claim, action, suit, demand or proceeding, that may be made or brought as a result of an advertisement being discriminatory or misleading, misrepresentative or deceptive, or that is in anyway related to the advertisement.

3. Special conditions for recruitment agencies and other third party recruiters

a. Third party recruiters must provide the name of the client organisation to the UTS Careers Service, if requested to do so.
b. The UTS Careers Service will not disclose the name of the client organisation unless required to do so by law or at the behest of the recruitment agency.
c. Only genuine job vacancies are to be submitted.

4. Voluntary work

a. Preference will be given to voluntary work offered by not-for-profit and community organisations.
b. The work must be of relevance to industries or professions that are available to students and graduates.
c. All positions will be subject to approval by UTS Careers Service staff before being advertised to students.

5. UTS Careers Service will not accept the following advertisements

a. Commission-only jobs.
b. “Business Opportunities”.
c. Work involving any unpaid training / trial periods, or reduced pay for such periods, except where a Federal or State award makes allowances for such arrangements.
d. Work involving any illegal activity.
e. Any work which requires the employee to purchase a product or service, or offer a security deposit or similar as a condition of employment.
f. Any advertisement not advertising a genuine employment opportunity.

6. UTS Careers Service reserves the right to withdraw or refuse any advertisement where, in UTS Careers Service opinion

a. Non-compliance with these terms and conditions has occurred;
b. Misleading or incorrect information has been provided;
c. Complaints about the advertiser have been received; or
d. The job opportunity or language used in the advertisement is considered to be inappropriate.

7. Complaints procedure

In the instance that a UTS student or graduate makes a complaint about an advertiser using this service, UTS Careers Service may choose, at its own discretion, to investigate the complaint. In such circumstances the following procedure will apply:
a. The complaint will be documented.
b. The advertiser will be contacted for a ‘right of reply’. The advertiser must co-operate with the investigation and respond promptly to all enquiries.
c. Where, in the opinion of UTS Careers Service, the complaint is proven or the advertiser fails to co-operate with the investigation UTS Careers Service reserves the right, at its absolute discretion, to withdraw the advertisement immediately.
d. An advertiser will be informed, where practicable, verbally or in writing if the advertisement is withdrawn or if access to the service is refused.

8. Other information

a. Advertisers can lodge job advertisements via the Internet at any time.
b. All advertisements will be reviewed by staff of the UTS Careers Service before being made available for access by students / graduates.
c. Advertisements are processed Monday to Friday between 9:00am and 5:00pm (EST), except for public holidays and University holidays.
d. The University does not act as an agent for the employer. Students or graduates interested in applying for positions will make direct contact with employers.
e. The University shall not be responsible for any faults or delays in displaying the advertisement where that fault or delay was not caused by the University or was beyond the University's reasonable control.
f. The University excludes, where permitted by law, all warranties and liabilities in the provision of this service other than those outlined in these terms and conditions.
g. In any event, the level of liability of the University to the advertiser shall not exceed the level of fee paid by the advertiser. For the avoidance of doubt the University shall not be liable for any direct or indirect consequential loss or loss of profit.
h. The terms and conditions are governed by the law of New South Wales. Prospective employers agree to submit to the non-exclusive jurisdiction of the Courts of New South Wales.
